Form I-9 Still in Effect Despite Expiration

“All good things must come to an end” is a nice saying that has nothing to do with the Form I-9. It’s neither coming to an end nor is it a good thing. It is little more than a paperwork nuisance stemming from an archaic immigration system which, if completed incorrectly, or not at all, could result in significant fines.    

But, these forms I-9 do expire from time-to-time and the current version with an effective date of 7/17/17 (indicated in the bottom left corner of the document) is set to expire August 31, 2019.  The Department of Homeland Security, however, cue surprise, is not ready to release the new version of the form.  They have accordingly extended its use indefinitely until the newest form is issued, which, at that point, all employers in the U.S. will need to use.  We are left to wait patiently for the new version.  In the meantime, employers are directed to continue to use the 7/17/17 form until instructed otherwise.
