EEO-1 Component 1 Data Collection

Today we’ll be discussing new guidance from the Occupational Health and Safety Administration (OSHA) regarding adverse reactions to COVID-19 vaccines.

Time to get your EEO-1 Component 1 data together! After a delay in 2020 due to the COVID-19 pandemic, the Equal Employment Opportunity Commission (EEOC) is now collecting EEO-1 data from 2019 and 2020. Covered employers have until July 19, 2021 to submit their reports.

What’s the EEO-1 Component 1 Report?

The EEO-1 Component 1 report is a mandatory annual data collection that requires certain covered employers to submit demographic workforce data to the EEOC. It contains information about employees’ job category, race/ethnicity, and sex.

The EEO-1 job categories include:

• Executive/Senior Level Officials and Managers

• First/Mid-Level Officials and Managers

• Professionals

• Technicians

• Sales Workers

• Administrative Support Workers

• Craft Workers

• Operatives

• Laborers and Helpers

• Service Workers

Which employers are covered?

All private-sector employers with over 100 employees and certain federal contractors with 50 or more employees must submit EEO-1 Component 1 reports.

How much of this data do we need to provide?

Because the EEOC held off on collecting 2019 data due to the COVID-19 pandemic, covered employers must now submit EEO-1 Component 1 data for 2019 and 2020.

A lot of our employees work from home now. How should we include them in our reports?

Employees who work from home should be included in the EEO-1 Component 1 data for the office to which they report. Employers should not use employees’ home addresses for the company address.

How do we submit our data?

The EEO-1 Component 1 reports should be submitted through the EEO-1 Component 1 Online Filing System. Covered employers should have received a 2019 and 2020 EEO-1 Component 1 notification letter in the mail, which includes a Company ID and Passcode employers can use to create a user account. The EEOC provides an online form employers can use to upload their data using the Online Filing System. This form can be used to submit data any time between now and July 19, 2021. Employers may upload their own data files (so long as they comply with the EEOC-approved specifications) beginning May 26, 2021
